GASP Files Notice of Intent to Sue LTV

Pittsburgh, PA, January 26, 1998 — Today the Group Against Smog and Pollution has issued a 60-day notice of intent to sue LTV Steel Company, Inc. for past and present violations of the Pennsylvania Clean Air Act Implementation Plan. As concerned as we are about the personal hardships that will be endured if this plant closes, we have no choice but to act to protect the public health. We have held off taking action while waiting for the arbitrators’ decision and LTV’s response to their ruling. By LTV’s own admission, the plan they propose to EPA will not bring the facility into compliance with the law. Moreover, LTV demands that the company be granted immunity, so that the inadequate measures they propose to take will be accepted by EPA as constituting compliance for the indefinite future.

GASP cannot wait while health-based protections of the public are ignored. GASP has issued its notice in order to guarantee the protections to which the public is entitled.
